Applying for Temporary Visa on Grounds of Extraordinary Ability

There are several types of temporary visas. These include the ones that are issued for students, entertainers and athletes, cultural exchange, treaty traders, skilled workers, treaty investors, managers and executives, religious workers and exchange visitors, temporary workers and extraordinary ability visas. An extraordinary ability Visa is categorized as Aliens with Extraordinary Ability or O-1 and Accompanying or Assisting Aliens or O-2.

This O category of visas is designated for:

v      Aliens with extraordinary ability in the field of arts, business, athletics, education and sciences

v      The spouse or child of the alien with extraordinary ability

v      The support staff of an athlete or an artist

In order to be eligible for such a visa, the alien should come to the country in order to work in his or her area of expertise.

The documents that need to be submitted for a successful petition include:

v      Original scholarly or scientific work of the applicant that contributes significantly to the development of their respective field of expertise

v      An opinion in written from an associate in the same peer group who is an expert in the same field

v      Sufficient evidence of the successful work of the alien in the form of internationally acknowledged awards, in the stature of the Nobel Prize or any three of the following criteria needs to met

  • Membership of an association that is globally renowned in the particular field and only accepts people credited with outstanding achievements.

  • Recipient of a national or an international award for excellence

  • Published work in major trade publications, media journal or newspapers

  • Part of a panel or acts as judge examining the work of others

  • Employment in an important position in an establishment or organization.
